Condition of Sale Policy
Introduction
- This Policy outlines the terms and conditions that apply to the sale of goods and/or services by Superior Extrusions Ltd. to the buyer.
Price and Payment
- All prices are listed in Canadian dollars (CAD) and are subject to change without notice.
- Payment must be made in full prior to delivery/shipping unless otherwise agreed in writing.
- Accepted payment methods: Bank Transfer and Cheque.
- Orders are made subject to credit approval; otherwise, terms shall be cash with order. Any accounts past due over 45 days will have their terms changed to COD. Any accounts past due over 60 days will automatically go to a collection agency. The purchaser will be held responsible for any and all legal or collection fees if the debt exceeds credit terms, and agrees to pay 2% per month on outstanding balances.
Order Confirmation
- An order is considered confirmed once Superior Extrusions Ltd. issues written confirmation to the buyer.
- Purchaser agrees to accept and pay for shipments of quantities plus or minus 10% purchase order.
- Superior Extrusions Ltd. reserves the right to decline any order for any reason.
Delivery/Shipping
- Estimated delivery dates are provided as guidance only and may be subject to delays due to unforeseen circumstances.
- Shipping costs are the responsibility of the customer unless otherwise agreed
Returns and Refunds
- No goods shall be returned without the written consent of the manufacturer. Damages, quality issues and/or shortages must be reported within 14 days of receipt of goods. Restocking fees of 30% will be applied to goods returned within three months of purchase date, after authorization and verification of quality by Superior Extrusions Ltd.; shipping is the responsibility of the customer; special orders or special colour may not be returned for restocking. Return requests must be submitted within 14 days of receipt of goods.
Cancellation
- In the event of a cancellation of a purchase order, or blank purchase order, the customer agrees to pay for all raw materials ordered or product produced up to the date that the cancellation was received by Superior Extrusions.
Guarantees
- Superior Extrusions Ltd. Guarantees the material to be as indicated in our quotation or an equivalent.
- The warranty does not cover damages due to misuse, negligence, or unauthorized modifications.
Limitation of Liability
- Superior Extrusions Ltd. is not liable for any indirect, incidental, or consequential damages arising from the sale or use of its products/services.
- Liability to Superior Extrusions Ltd. is limited to the extent of the value of the product only. We accept no liability for loss or damage caused by lack of instructions from the purchaser, strikes, or other industrial disputes, accidents, or any cause beyond our reasonable control.
Dies Stewardship
- All customer owned dies will be kept in our plant at all times, and will not be released unless Superior Extrusions Ltd. approves and customer account is in good standing. We guarantee to keep dies in good condition at all times, safe from wear caused through prolonged use, when modification may be necessary at customers’ expense.
Governing Law
- This agreement is governed by the laws of the Province of Ontario.
- Any disputes arising from the sale are subject to the exclusive jurisdiction of the courts of Ontario.
Changes to the Terms
- Superior Extrusions Ltd. reserves the right to update these terms and conditions without prior notice.
